Official position of project press-servise of residential district
Taking into account the fact that a lot of unofficial information regarding the lawfulness of the construction of the residential district "Rybalsky" has recently appeared on the Internet and in the media, the press service of the project considers necessary to clarify the situation regarding the procedure for using the land on which the construction is being carried out.
Note, that the land plot with the intended use (type of use) - "exploitation and maintenance of the property complex" was provided for use to the "KYIVSKY RICHKOVY PORT" Public Joint Stock Company by the Decision of the Kyiv City Council No. 907/907 as of 28July, 2016. The land lease agreement was concluded on 13 October, 2016 in pursuance of the above-mentioned Decision.
The Detailed plan of the territory within the streets of Elekrykiv and Naberezhno-Rybalska Streets in the Podil district of Kyiv was by Decision of Kyiv City Board No. 96/1100, as of September 29, 2016, and it provides for the reallocation of the territory for multifunctional development (residential, public and other uses).
It is important to emphasize that the existing innovations in the land code for determining the type of use of land provide the opportunity to change the type of use by the decision of the land user (but subject to urban planning documentation), which also meets the conditions specified in the lease contract.
For today, information on the land plot is contained on official resources of state bodies - in the Public Cadastral Map of Ukraine and the City Information and Analytical System for Providing Urban Development Activity "Kyiv City Planning Cadastre". Its Purpose is for the construction and maintenance of other buildings of public construction. Functional zone is the territory of public buildings and structures (existing). Taking into account the above-mentioned facts, the construction of the Residential District is carried out within the limits and in the manner prescribed by law.
Of course, we understand the increased attention to the construction of this territory, but we believe that the position stated in the statement of the Prosecutor's Office of Kyiv, namely, "the use of land plot is not intended" is based on false assumptions and goes beyond the authority of the body.
We sincerely hope it was done unintentionally and we intend to defend our interests in the court, the decision of which will finally stop a wave of unjustified and groundless criticism of the legal status of the project.
