Riverside Development will appeal against the court judgment abolishing the Detailed Territorial Plan of the Rybalsky peninsula before it enters into force
The Riverside Development will appeal against the judgment of the Kyiv District Administrative Court which has not yet entered in force, recognizing as unlawful and abolishing the judgment of the Kyiv City Council "On approval of a detailed plan of the territory within the boundaries of the Elektrykiv Street and Naberezhno-Rybalska Road in Podilskyi District of Kyiv”. According to the announcement of the court press office, this judgement was justified by the fact that the Detailed Territorial Plan contradicts the norms of the General Plan for the period till 2020 and was approved without public hearings being held.
“We are completely sure that the Detailed Territorial Plan has been developed in accordance with the current General Plan and Draft of the General Plan 2025, - notes the CEO of the Riverside Development Andrii Vavrysh. – It is surprising that the court took a stand different from the common judicial practice with regard to the detailed plans of the territories. In a written proceeding the judge, obviously, did not have an opportunity to study a specific evidentiary basis. We are sure that we will be able to address this issue in more detail during the appeal process”.
The current General Plan provides clearing of a part of the riverside territory of Podil- Kurenivskyi industrial district which can be included into the existing districts without breach of sanitary and hygienic standards, for construction of new residential buildings. Particularly, it is proposed in the document to modify “the southern and central part of Podil-Kurenivskyi industrial district, namely Rybalsky peninsula, for multipurpose use. The developer of the General Plan Public Utility “Institute of the General Plan of Kyiv” draws attention to a “possible construction of residential and public buildings on the territory of Rybalsky peninsula”.
Construction of the RYBALSKY residential neighbourhood is being carried out for the intended purpose – this is a multifunctional territory and we have every right to build a multifunctional complex here for residential, commercial and public purposes.
Public hearings with regard to the Draft of the Detailed Territorial Plan have been held in accordance with the current legislation, what may be approved by the log of registration of proposals and comments of the citizens, as well as by the report on the results of consideration and acceptance of proposals and comments of the public.
