Court of Appeal recognized the Detailed Territorial Plan of the Rybalsky Peninsula as lawful
Today, the 3rd of April, the Kyiv Administrative Court of Appeal abolished the judgment of the Kyiv District Administrative Court abolishing the decision of the Kyiv City Council "On approval of a detailed plan of the territory within the boundaries of the Elektrykiv Street and Naberezhno-Rybalska Road in Podilskyi District of Kyiv”.
Thus, the Court of Appeal decided to dismiss the statements of claim of the deputy Yurii Levchenko and refuted the conclusions of the court of first instance regarding inconsistency of the Detailed Territorial Plan of the Rybalsky Peninsula with the current General Plan for 2020. Therefore, implementation of multifunctional development in the place of the former industrial district shall be deemed lawful, and the position of the plaintiff regarding interpretation of the provisions of the General Plan shall be deemed far-fetched.

We had no doubt for a moment that after examining all the details of the case and having a thorough review of the General Plan and detailed plan of the territory within the boundaries of the Elektrykiv Street and Naberezhno-Rybalska Road, the court will decide on the lawfulness of the DTP, - emphasizes the CEO of the SAGA Development Andriy Vavrysh. – We, in our turn, continue to work on the Rybalsky project and create a comfortable space for the life and rest of Kyivans."
Appeals to the Decision of the Kyiv District Administrative Court were filed by the defendant in the case – the Kyiv City Council, as well as Riverside/SAGA Development and the Department of Urban Development and Architecture of the Kyiv City State Administration, being the third parties in the process. The Kyiv Administrative Court of Appeal upheld all three appeals.
